Privacy Policy

From time to time Carejobz Pty Ltd (ABN: 37 663 978 041) (“the Company”) is required to collect, hold, use, and/or disclose personal information relating to individuals (including but not limited to candidates, clients, suppliers, referees, contractors, and employees) in the performance of its business activities.

This document sets out the Company’s policy in relation to the protection of personal information under the Privacy Act 1998 (“the Act”) and the Australian Privacy Principles (“APPs”). The APPs regulate the handling of personal information.

What is personal information?
Personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

Employee records
This policy does not apply to the collection, holding, use, or disclosure of personal information that is an employee record. An employee record refers to personal information relating to the employment of an employee. Examples include health information, and details about the engagement, training, disciplining, resignation, termination, and employment terms and conditions. Please refer to the Act for further examples.

The exemption applies to current or former employees. It does not apply to contractors, volunteers, or prospective employees. Despite this exemption, the Company may have other obligations regarding employee records, for example under the Fair Work Act 2009 and the Fair Work Regulations 2009.

Kinds of information that the Company collects and holds
The Company collects personal information that is reasonably necessary for one or more of its functions or activities. The type of information the Company collects depends on your relationship with the Company. For example:

  • Candidate: If you are a candidate seeking employment, the Company may collect your name, address, email address, contact telephone number, gender, age, employment history, references, resume, medical history, emergency contact, taxation details, qualifications, and payment details.
  • Client: If you are a client, the Company may collect your name, address, email address, contact telephone number, gender, and age.
  • Supplier: If you are a supplier, the Company may collect your name, address, email address, contact telephone number, business records, billing information, and information about goods and services supplied by you.
  • Referee: If you are a referee for a candidate, the Company may collect your name, contact details, current employment information, and professional opinion of the candidate.

Sensitive information: The Company will only collect sensitive information with your consent unless an exception under the APPs applies. Sensitive information may include information about your racial or ethnic origin, political opinions, religious beliefs, membership of a trade union, sexual preferences, criminal record, health information, or genetic information.

How the Company collects and holds personal information
The Company will collect personal information by lawful and fair means, and typically directly from you when reasonable and practicable. Collection methods may include:

  • Application forms
  • Emails or other written correspondence
  • Phone calls
  • In-person interactions
  • Transactions
  • The Company’s website
  • Skills Assessment forms
  • Communications technology
  • Third-party sources, including referees, past employers, or public information such as social media

If personal information is collected via third parties, the Company will handle such information in compliance with the APPs. The Company uses both hard copy and electronic systems, including cloud storage, and Jobadder database to store personal information.

Purposes for which the Company collects, holds, uses, and/or discloses personal information
The Company will collect personal information when it is reasonably necessary for one or more of its functions or activities. The main purposes may include but are not limited to:

  • Recruitment functions
  • Customer service management
  • Training and events
  • Surveys and research
  • Business relationship management

Direct marketing
The Company may use or disclose personal information for direct marketing purposes unless you opt out by contacting the Privacy Officer in writing or through the Company’s website.

Disclosure of personal information
The Company may disclose your personal information for the purposes for which it was collected or if required by law. This may include disclosure to related entities, clients, or contracted service suppliers (e.g., IT providers, financial institutions, and external advisors).

Access to personal information
You may request access to your personal information by contacting the Privacy Officer. The Company will respond within a reasonable period, and a fee may apply.

Correction of personal information
If you believe the information held by the Company is incorrect or outdated, you may request a correction by contacting the Privacy Officer.

Integrity and security of personal information
The Company takes reasonable steps to ensure that personal information is accurate, up-to-date, and secure. If the Company no longer requires the information, it will be destroyed or de-identified.

Anonymity and pseudonymity
You may interact with the Company anonymously or under a pseudonym unless impracticable or required by law.

Overseas disclosure and cloud services
The Company may disclose personal information overseas, such as to cloud service providers. Reasonable steps will be taken to ensure compliance with the APPs. Likely overseas recipients may be located in countries such as, (but not limited to) The United Kingdom, Ireland, Singapore, the Philippines, the UAE, New Zealand, the USA & Canada.

Notifiable data breaches
In the event of a Notifiable Data Breach, the Company will assess the breach and notify affected individuals and the Office of the Australian Information Commissioner where required.

Complaints
If you have concerns about how the Company handles your personal information, you can lodge a complaint with the Privacy Officer. If unsatisfied with the response, you may escalate the matter to the Office of the Australian Information Commissioner.
